The holder of all rights on the website www.royalvisnjan.com is the company Dimac d.o.o..

Dimac d.o.o. provides sales services through its service – Web Shop via the aforementioned website. By using the Web Shop service and all associated pages and services on the www.royalvisnjan.com domain, it is considered that customers are familiar with these Terms and Conditions (hereinafter: Terms) at all times, and that they fully understand and accept them.

These Terms apply to the rights and obligations relating to the purchase of products or services through the Web Shop and the rights and obligations arising from the conclusion of a Distance Selling Contract (hereinafter: Contract) between the customer as the end buyer and the Web Shop, and are considered an integral part of such contracts. Customers are advised to familiarize themselves with these Terms before purchasing and to check them regularly to be aware of all their rights and obligations.

Dimac d.o.o. reserves the right to change these Terms at any time without prior notice and will not be liable for any possible consequences resulting from such changes. These changes take effect upon publication on these websites.

Dimac d.o.o. reserves the right to cancel the service and change the content as well as other services and sub-pages that are an integral part of the Web Shop at any time without prior notice and will not be liable for any possible consequences resulting from such changes. Dimac d.o.o. reserves the right to change, limit, or terminate the provision of the Web Shop service at any time without prior notice, including partial or full restriction of access as well as the provision of certain services to users who violate the provisions of these Terms and the Privacy Statement. The Web Shop fully disclaims any responsibility for the accuracy and/or completeness of all information and content located on www.royalvisnjan.com . Dimac d.o.o. reserves the right to errors in the description and image of the product. Product images in the Web Shop are illustrative. Images illustrating the product on the website www.royalvisnjan.com may not fully correspond to the actual appearance and content of the product, and the customer cannot complain about such products on that basis.

Dimac d.o.o. will strive to publish accurate and up-to-date data on the websites www.royalvisnjan.com, but does not assume responsibility for their accuracy and completeness.

3. AVAILABILITY OF INFORMATION

The Web Shop undertakes to provide the customer with the following information before they are bound by a contract or offer: information about the company Dimac d.o.o. (name and headquarters, OIB), contact information allowing fast and efficient communication (contact email, phone), essential characteristics of the items, availability of items (every item offered on the website should be available within a reasonable period), delivery conditions, prices which must be clearly and unambiguously determined and must evidently show whether they already include taxes and transport costs, the period in which it is possible to withdraw from the contract and conditions for withdrawal, and an explanation of the complaint procedure.

4. ORDER

The sales contract between the Web Shop and the customer in the web shop is concluded at the moment the Web Shop sends the first email to the customer about the status of their order (order confirmation). From that moment on, all prices and other conditions are fixed and valid for both the Web Shop and the customer. The customer is the person with the data provided during the order placement. Subsequent changes to customer data are not possible.

5. TERMS AND PURCHASE PROCEDURE

The main characteristics of the products, use, prices, special promotions and benefits, payment and delivery methods refer to those products valid at the time the order is concluded. These data will be indicated next to each product. The price of the product, which includes VAT and delivery costs, is visible in the shopping cart before the order is concluded. The delivery cost may also be visible on other parts of the page.

All information about purchase confirmation based on an electronic order will be sent to the customer's email address provided during the registration/order process or in the shopping cart when entering data during order conclusion. If the customer does not receive an order confirmation notification, there is a possibility that they entered their email address incorrectly. In this case, please contact us at: info@royalvisnjan.com so our customer service can check if the order has been received.

When ordering, the customer undertakes not to place false or misleading orders. Using a false identity or misleading orders is considered an attempt at fraud, and we reserve the right to inform the competent authorities about abuse. 6. PAYMENT METHOD AND PROCEDURE

All prices are expressed in euros (EUR), and VAT is included in all prices. The product price does not include delivery costs, which are added to the total price of the product or service.

Prices may change at any time. However, changes will not affect orders for which we have sent an order confirmation. After you have selected all the items you want to buy, they will be added to your cart. The next step is order processing and payment. For this purpose, it is necessary to follow the steps within the cart and provide or confirm the requested data at each step.

Payment of the product price and delivery costs can be made in one of the following ways:

a) Payment by general payment slip: Products for which an order has been concluded can be paid by payment slip at all bank branches, FINA, or Croatian Post offices. After order confirmation, the Web Shop sends the data needed for payment by email. All data must be correctly entered in the payment slip and payment must be made within the deadline.

b) Payment via mobile banking: Products for which an order has been concluded can be paid via mobile banking of any bank where such a payment method is enabled. After order confirmation, the Web Shop forwards all necessary data for payment via email.

7. PURCHASE NOTIFICATION PROCEDURE

7.1. Order
After placing the order by confirming the last step of the cart, the customer receives an email notification that the order has been received. The Web Shop reviews the order, checks the availability of ordered items, checks the correctness of the order, and confirms or reasonably rejects the order. The Web Shop may call the customer on their contact telephone number to verify data or ensure delivery accuracy. Delivery of items that the Web Shop does not have in stock depends exclusively on the supplier and the time within which the supplier can deliver the items to the Web Shop.

The Web Shop assumes no responsibility for damage caused by longer delivery times or due to non-delivery of items that the Web Shop does not have in stock.

7.2. Order dispatched/Order ready for pickup
The Web Shop prepares the item within the agreed period and sends it for delivery, notifying the customer via email about the contract withdrawal policy, whom to contact in case of delivery delays, and whom to contact in case of a complaint. If the customer decides to cancel the order in a timely manner, they must immediately notify us via email at info@royalvisnjan.com

8. PURCHASE FOR LEGAL ENTITIES – R1

The purchase procedure for legal entities is the same as for natural persons; just select R1 account for a company in the first case and confirm agreement with the Terms and Conditions. If you want an R1 invoice, you accept the Terms and Conditions valid for legal entities.

The Terms and Conditions of the Web Shop apply to purchases by legal entities. Consumer protection rules prescribed by the Consumer Protection Act do not apply to legal entities.

9. CUSTOMER'S RIGHT TO WITHDRAW FROM THE CONTRACT

9.1. Conclusion of the contract
These Terms, as well as individual sales conditions indicated next to information about certain products, represent Dimac d.o.o.'s offer for concluding a Contract, and the customer, by accepting the offer, concluding the order, or in another way determined by these Terms, accepts them, whereby a Contract is considered concluded between the customer and Dimac d.o.o., according to the sales conditions stated in these Terms.

The subject and commercial purpose of the Contract is the purchase of the selected product or service via the web shop with the payment of the corresponding fee – the price of that product or service. The Contract is concluded using means of distance communication (Distance Contract) via: printed advertising messages with an order form, telephone with and without human intervention, and the Internet. The Contract enters into force and is binding from the moment the customer accepts Dimac d.o.o.'s offer in one of the following ways:
– by selecting payment and completing the order as a customer through the Web Shop
– by selecting payment and completing the order via email at info@royalvisnjan.com

a) Registration of a user account is not required for an order; all customer data is entered during the first order as part of step 2 of the shopping cart. All data entered must be true, and the use of other people's data is strictly prohibited.

b) Customer data is stored within cookies for a period of 9999 days unless otherwise set in the customer's web browser.

c) For violation of the provisions of the Terms in this chapter, Dimac d.o.o. reserves the right, at its discretion, to reject the customer, without obligation to compensate the user for any cost or damage.

d) The Contract enters into force from the day the customer accepts the offer to conclude such a Contract.

e) Upon conclusion of the Contract, the customer will be provided with: Terms and Conditions containing a notice of the customer's right to unilateral termination of the Contract with the form for unilateral termination of the Contract from Article 61, paragraphs 1 and 2 of the Consumer Protection Act.

9.2. Right of unilateral termination of the contract
Pursuant to Art. 79 of the Consumer Protection Act, the customer does not have the right to unilateral termination of the product sales contract because the subject of the contract is perishable goods or goods that expire quickly or goods made according to the Customer's specifications (in case of an additional message on a cake and/or dessert).

10. LIABILITY

10.1. Product images on the website/web shop are indicative. The actual product may deviate from them, especially considering possible deviations in the raw materials used. Product ingredients are listed on the website/web shop. The user is obliged to familiarize themselves with the product ingredients before use and to contact Dimac d.o.o. in case of any doubts or questions. If the user is allergic or, due to their health needs, must not consume certain ingredients commonly used in desserts, the user is advised to contact Dimac d.o.o. specifically and check the method of product preparation before consumption.

10.2. Dimac d.o.o. is responsible for the quality of the sold product in terms of its health safety. In case of complaints regarding the product, the Customer is obliged to return it to a Dimac d.o.o. branch. The Customer has no right to compensation for costs associated with returning the product.

10.3. In case of a defective product, Dimac d.o.o. will replace it for the Customer with another correct product. If this is not possible, Dimac d.o.o. will refund the amount paid. The Customer has no right to compensation for any other indirect damage.

10.4. Dimac d.o.o. is not liable for any damage caused by untimely delivery of products nor for damage that might occur due to internet connection interruption while using the web shop.

11. COMMUNICATION OF THE WEB SHOP WITH USERS

By purchasing, you consent that the Web Shop, for the purpose of promoting services and products, may notify you via email about changes or additions to the page content, discounts, promotions, products, or changes in the method of service provision. The user can revoke said consent at any time.

12. DELIVERY

Delivery is performed exclusively in the area specified in step 1 of the cart and offered in step 3 of the cart. The Customer is obliged to pick up the purchased products at the address and on the date specified during the purchase. If the Customer does not pick up the product on the selected date, Dimac d.o.o. has the right to remove it. In that case, the Customer remains obliged to pay the price of the purchased product.

13. SECURITY

The Web Shop uses appropriate technological and organizational means to protect the transmission and storage of personal data and payments.

14. PROTECTION OF PERSONAL DATA

The Web Shop undertakes to permanently protect the personal data of users in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 and the Personal Data Protection Act. Read more under the Privacy Statement.

15. LIMITATION OF LIABILITY

The Web Shop strives to its best ability to ensure the timeliness and accuracy of the data published on its websites. Nevertheless, item characteristics, delivery time, or price can change so quickly that the Web Shop fails to correct the data on the websites. In such a case, the Web Shop will notify the customer of changes and allow them to withdraw from the contract or replace the ordered item. The Web Shop is not responsible for the content of opinions – reviews about items written by visitors. Before publishing, the Web Shop reviews and rejects opinions – reviews that contain obvious falsehoods, and which are inappropriate, misleading, or offensive. The Web Shop is not responsible for the information in opinions – reviews and disclaims any responsibility arising from the information stated in opinions – reviews. The Web Shop has the option to withdraw from the contract only if an obvious error is established (Civil Obligations Act of the Republic of Croatia). An obvious error is considered an error in essential characteristics and all misconceptions that, according to trade practice or the intention of customers, are considered decisive and which the Web Shop, in case of knowledge, would not have confirmed or concluded the contract. This also includes obvious errors in price.

16. GENERAL TERMS AND CONDITIONS OF USE

16.1. Use of the internet service pages
It is forbidden to use the pages and content for any purpose that does not relate to business with the Web Shop, or in any way that is not in accordance with these Terms. The Customer confirms and guarantees that they will use these pages in accordance with these Terms and all applicable laws and rules, including, without limitation, all those relating to the internet, email (electronic mail messages), data, and privacy. The Customer confirms and guarantees that they will use the downloaded content exclusively in a manner consistent with these Terms; otherwise, such use is considered unauthorized, in which case Dimac d.o.o. is authorized to claim compensation for damages from the user and to fully or partially restrict the sale and provision of services.

16.2. The customer-guest undertakes that all data for concluding the Purchase Contract are true and accepts all the previously mentioned terms.

16.3. Content, software, services, and applications of the internet service
All content displayed or located in/on the Web Shop, including but not limited to published text, graphics, illustrations, photographs, audiovisual works, sound, documents, data, and information, may not be reproduced, distributed, or used in any way that is contrary to these Terms. In particular, it is expressly forbidden to modify, publish, transmit, sell, display, process, copy, or in any other way exploit the content, visual identity, applications, and software of the Dimac d.o.o. Web Shop, except exceptionally when such a possibility is provided for by these Terms or is the result of prior approval from Dimac d.o.o. Use of the Web Shop services for commercial purposes in any way and use in a manner contrary to these Terms is prohibited. Storage or copying of content for any purpose and in any way and use in a manner contrary to these Terms is expressly prohibited. In case of unauthorized, inadmissible, and/or illegal use of any content (text, photographs, applications, software, audiovisual works) of the Web Shop, Dimac d.o.o. reserves the right to claim compensation for all damages and to initiate civil and criminal proceedings before the competent courts against the legal and/or natural person who uses the Web Shop in the described manner. Use of the Web Shop services is granted to adults. The use and utilization of the Web Shop by children is permitted only under the supervision of parents and/or guardians, and they are obliged to take care of it; otherwise, they assume all rights and obligations arising from such use, and Dimac d.o.o. is not responsible for any consequences of such use.

17. COMPLAINTS AND DISPUTES

The Web Shop respects the applicable consumer protection law. Complaints are submitted to the email address info@royalvisnjan.com. The complaint handling process is confidential. The Web Shop is aware of the essential characteristic of consumer disputes – the disproportion between the economic value of the claim and the necessary time and costs arising from dispute resolution, which is also the main obstacle for consumers to initiate a dispute before a court. Therefore, the Web Shop strives to the best of its ability to resolve disputes amicably.

Out-of-court settlement of consumer disputes
We hereby inform you of our good will to resolve any dispute amicably by agreement, as well as your right to use out-of-court consumer dispute resolution mechanisms by initiating an out-of-court dispute resolution procedure by filing a report with the Court of Honor of the Croatian Chamber of Economy, and/or by submitting a proposal for mediation to the Mediation Center at the Croatian Chamber of Economy.

18. PERSONAL DATA PROTECTION POLICY

Under no circumstances will we misuse your personal data.
We will not disclose your contact data or your personal data to a third party unless required by law.
We will not send you electronic messages or notifications unless you have given consent, except in the case of electronic transactions.
Whenever you wish, you can simply unsubscribe from receiving our electronic messages or notifications.

The protection of our users' personal data is of special interest to our company. All Dimac d.o.o. activities on the Internet comply with European regulations (EU Directive 95/46/EC, 2002/58/EC and International Agreement ETS 108, ETS 181, ETS 185, ETS 189) and national laws in force in Central and Eastern European countries. In the Republic of Croatia, we also comply with the Personal Data Protection Act (N.N. 103/03.). Dimac d.o.o. adheres to Privacy Protection when obtaining data.

When you use our websites, we collect information about user interactions with the websites and content, including: device information and logs, i.e., system logs that include the date and time of the visit and the IP number of the device from which the connection was established, as well as statistical data on website browsing and traffic to and from individual pages. The purpose of the aforementioned actions is to improve the websites. Data stored in server logs are not related to individual persons using the website or system and are not used by the Administrator to identify users.
Subject to your express consent, we may also use technologies such as cookies and process personal data, such as IP address and cookie identifiers, to personalize displayed content and ads based on your interests, to measure the effectiveness of ads and content, and to obtain information about recipients who viewed ads and content.
In addition, subject to your express consent, your data may also be processed for the purpose of direct marketing via newsletter.

Our Web Shop uses "cookies" that are deleted after closing the web browser. You can delete or block "cookies" through your web browser or using software for those purposes. Disabling "cookies" may cause problems with the operation of the website.

You control the personal data you give to Dimac d.o.o. yourself.
